I. General Provisions
● Service Availability: Services are typically available 24/7, every day of the year, within a specified geographic area (e.g., the United States and Canada).

● Member/Policyholder Presence: You must be with the disabled vehicle when the service provider arrives. Services generally will not be performed on an unattended vehicle unless it is unsafe to remain with the vehicle.

● Liability: The roadside assistance company is generally not liable for the acts or omissions of the independent service providers they dispatch. The provider has exclusive control over their own equipment and person and or inability to use the service due to personal reasons and and or cancellation. Rescue Roadside Assistance Dispatch will not accept responsibility for repairs or the availability, delivery or installation of parts. All parts used and services provided by the service facility and or provider must be authorized and paid for by the customer

Terms and Conditions:

The annual membership fee is $229, which covers up to two dispatches per year. Each dispatch can be for a service up to 10 miles away or for any roadside service, including tire changes, fuel delivery, lockout services, or battery jumps. Prices may vary based on the breakdown circumstances, but the total amount will be communicated clearly prior to dispatch.

All services are considered final after dispatch. If damage occurs during service, it is imperative to call us within 24 hours of the incident. Your satisfaction is our top priority, so please feel free to reach out to us with any concerns.

Vehicle Towing: Up to 10 Miles in any direction: Any additional expenses incurred beyond the 10-mile limit are the responsibility of the customer, payable directly to our provider, and are not reimbursable.
Vehicle Winching: If a vehicle is stuck in a ditch, mud or snow and is accessible from a normally traveled roadway, dispatch coverage for winching is provided up to a $100 service limit. Any expenses incurred beyond the $100 service limit are the responsibility of the customer, payable directly to the provider, and are not reimbursable.

Fuel Delivery: A service vehicle will deliver up to 2 gallons of fuel to the customer’s location, where allowed. While the dispatch cost is covered, the customer is responsible for paying for the cost of the fuel which is charged as a flat rate at the time of service. If services cannot be performed or are not successful in returning the vehicle to safe operating conditions tow service will be provided. Each additional service will count as a separate event.

Jump Start or Minor Roadside Adjustments to Start Vehicle: Service is provided to jump start a dead battery or make other minor roadside adjustments to start the vehicle. Expenses for more extensive repairs, parts and labor are the customer’s responsibility, payable directly to the provider, and are not reimbursable. If services cannot be performed or are not successful in returning the vehicle to safe operating conditions tow service will be provided. Each additional service will count as a separate event.
Flat Tire: Service is provided to change a flat tire with your inflated spare. If no spare is available, the spare is unusable, the lug nuts cannot be removed, or the vehicle has multiple flat tires the vehicle may be towed. The tow will count as a separate event.

Lockout: Service is provided to gain access if the ignition key is lost or accidentally locked inside the vehicle. If services cannot be performed or are not successful in returning the vehicle to safe operating conditions tow service will be provided. Each additional service will count as a separate event.

Membership Fee and Services Covered:

Rescue Roadside Assistance Auto Pay

By enrolling in Rescue Roadside Assistance Dispatch Auto Pay, you authorize your annual membership dues to be charged to your payment method on file. Your membership will renew automatically each year for another one-year term unless you provide a termination request prior to your membership expiration date. You may do so by calling 833-xxx-xxxx or sending an email to support@rescueroadsideassistance.com.
If your payment method fails, your enrollment in Rescue Roadside Assistance Dispatch Auto Pay and your membership may be canceled.

Payment Authorization:

By signing up for Rescue Roadside Assistance Dispatch, you authorize our company to charge or debit the indicated amount using your payment method, enroll you in Auto Pay, and automatically continue your membership annually as per the Auto Pay Terms and Conditions. You may cancel Auto Pay at any time by contacting us or sending us an email at support@rescueroadsideassistance.com
Please note that by providing your phone number on our website or to our agents over the phone, you consent to receive autodialed personal text messages from us to your mobile number.
Service Updates: We would send you text messages to inform you about the status of your roadside service, including dispatch notifications, service provider arrival times, service completion confirmations, and other service-related information to ensure a seamless

CLASS ACTION WAIVER

By accepting these Terms and Conditions, you and Rescue Roadside Assistance Dispatch agree to resolve any and all disputes between us on an individual basis. You and the Company hereby waive any right to bring or participate in any class action, collective action, private attorney general action, or other representative proceeding against the other party.

You understand that by agreeing to this waiver, you are giving up the right to bring a claim against the Company in any court or arbitration forum as a member of a class or on behalf of others. This means that all disputes must be brought solely in your individual capacity.

1. Applicability of Waiver: This Class Action Waiver applies to all claims, disputes, or controversies, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, that arise from or relate to your use of Rescue Roadside Assistance services, your account, or this agreement.

2. Severability: The parties acknowledge that this Class Action Waiver is a material and essential term of this Agreement and is non-severable. If a court of competent jurisdiction finds this waiver to be unenforceable for any reason, then the entire Dispute Resolution provision of this Agreement shall be void and unenforceable with respect to that particular claim, and that claim must be resolved in a court of law.

3. No Jury Trial Waiver: This Class Action Waiver is separate from and does not affect any jury trial waiver that may be included in this Agreement.

4. Complete Agreement: These terms and conditions constitute the entire agreement between you and Rescue Roadside Assistance Dispatch regarding the use of the service, superseding any prior agreements between you and Rescue Roadside Assistance Dispatch relating to your use of the service.
